Nazaré Surf ClubPortugal · Legal information

Draft for review · 13 October 2026

Terms & Conditions

1. Provider and scope

Nazaré Surf Club is the trading name used here for Benoit Mateus Oliveira, NIF 283767260, at Rua da Escola, 4 — 2530-323 Lourinhã, Portugal. Contact: admin@nazaresurfclub.com. These terms cover coaching and preparation sessions delivered in Portugal.

2. Enquiries and booking

A readiness call or website enquiry is free and creates no obligation to buy. A booking is confirmed only after you receive and accept a written offer identifying the provider, contact telephone, activities, locations, dates or performance period, total price including taxes, payment schedule, inclusions and cancellation terms. You receive the applicable terms in a form you can retain before committing to payment. Additional services require your express agreement.

The advertised base package is €5,520, VAT included, for 27 private sessions, including two at Nazaré. The written offer identifies the agreed coaching schedule and each service’s price or allocation for calculating any partial refund. Travel and accommodation are excluded unless expressly included in that offer.

3. Readiness and delivery

The recommended preparation period is approximately two months. Coaching is adapted to your starting level, progress, health clearance and ocean conditions. The team retains authority to postpone, adapt or stop an activity for safety. Booking does not guarantee a particular wave size, surfing a big wave, or a particular performance outcome.

4. Weather & Swell Guarantee

If ocean or wind conditions prevent your two Nazaré sessions during your planned window, the undelivered sessions remain valid for 12 months after the end of that window, with priority re-booking and no additional session fee. Re-booking remains subject to safe conditions, readiness and available dates. This guarantee does not include travel or accommodation expenses.

You may request an alternative date or a refund for an undelivered service where required by law or these cancellation terms. The guarantee is an additional option; it does not oblige you to accept credit or remove a right to a refund.

5. Cancellations and refunds

Send cancellation or rescheduling requests to admin@nazaresurfclub.com. The following existing club policy applies to the affected booked session or service, rather than automatically forfeiting the whole package:

For a package, deductions relate only to delivered services and reasonable, evidenced, unrecoverable loss attributable to the cancelled service. They cannot exceed the price of that service. No automatic blanket forfeiture applies.

6. Distance-booking withdrawal rights

For a leisure service booked for a specific date or period, the statutory 14-day withdrawal right may not apply under article 17(1)(k) of Decree-Law 24/2014. This does not remove the contractual cancellation rights shown here or remedies for non-performance.

For a distance contract that is not within an exception, the consumer keeps the statutory withdrawal right. If the consumer expressly asks on a durable medium for service to begin during that period and later withdraws, only the lawful proportional amount for service actually supplied may be charged. A fully performed service ends the withdrawal right only after the required prior express request and acknowledgement.

Refunds are returned to the original payment method without undue delay after entitlement is confirmed. No deduction may exceed the price paid for the affected service. The club must be able to explain and evidence any deduction; sums relating to services not supplied remain refundable where required by law.

Where the statutory withdrawal right applies, you have 14 days from concluding the service contract to notify us by an unambiguous statement. You may email: “I withdraw from my contract for the following service”, identifying the booking, your name and the contract date. No particular form is compulsory. Refunds due under that right are made within the statutory deadline, ordinarily 14 days from notification, using the original payment method unless you expressly agree otherwise without additional cost.

7. Safety, insurance and participant information

Read the Sports Safety & Liability Waiver before booking. The booking documentation must identify applicable insurance, insurer, policy coverage and relevant registration details for the activities supplied. Activities must not proceed without legally required cover, qualifications, permissions and safety arrangements. No insurance or RNAAT registration number is asserted by this draft.

8. Liability and consumer rights

Nothing in these terms excludes or limits liability for injury, harm to health, intentional wrongdoing or other liability that Portuguese law prohibits excluding. Your statutory remedies for non-performance, defective performance and unfair terms remain available. A participant’s risk acknowledgement is not a release of the provider from its legal duties.

9. Complaints and dispute resolution

Contact us first with your booking reference and the remedy requested. You may also use the Electronic Complaints Book where applicable and the competent consumer dispute-resolution body. The booking documentation must identify the competent RAL entity and any binding membership before purchase. Consult the official list of consumer arbitration entities. This draft does not claim membership of a particular centre.

Portuguese law applies, subject to mandatory protections that apply to a consumer in their habitual country of residence. No exclusive court or arbitration clause removes mandatory consumer rights.

10. Applicable version and legal basis

The version supplied with your accepted offer governs that booking. Subsequent website changes do not unilaterally change an existing contract.
