Sports Safety & Liability Waiver

This document explains participation risks and safety duties for sessions in Portugal. It is an informed-risk acknowledgement, not a blanket release from liability. Reading this page or sending an enquiry does not sign or accept a waiver.

1. Nature of the activities and informed participation

The programme may include surfing, big-wave preparation, personal-watercraft safety, apnea or breath-hold work, strength and conditioning, recovery work, open-water activity and related transport or shore-based training. Ocean conditions are variable and cannot be made risk-free.

The participant acknowledges the ordinary and inherent risks explained before the activity, including immersion, waves and currents, impact, collision, equipment failure, cold, fatigue, panic, loss of breath, rescue and remote access to emergency care. This acknowledgement does not exclude or limit any liability that cannot lawfully be excluded or limited.

2. Health information and medical clearance

The participant must disclose, accurately and before participation, any condition, medication, injury, pregnancy, recent surgery, loss of consciousness or other circumstance reasonably relevant to safe participation, and must update that information if it changes.

A request for medical clearance is a safety prerequisite, not a diagnosis by the club. The participant must stop immediately, alert the coach and follow emergency instructions if symptoms or distress occur. Withholding material safety information may justify postponement or cancellation, subject to the refund terms below and mandatory law.

3. Safety authority and participant duties

The coach, safety lead and vessel or personal-watercraft operator retain final go, postpone, modify and stop authority. The participant must follow briefings, signals, boundaries and equipment rules; use supplied safety equipment as instructed; and must not participate while impaired by alcohol, drugs, illness or unsafe fatigue.

A safety cancellation is not an admission of fault. The commercial consequence is governed by the refund policy and the reason for the cancellation is retained in the operational record.

4. Liability and non-waivable rights

The participant accepts responsibility for loss caused by their own intentional or negligent breach of the stated safety instructions, to the extent permitted by law. Nothing in this document excludes or limits liability for death, injury or harm to physical or mental integrity or health, non-performance, defective performance, fraud, wilful misconduct or gross negligence where Portuguese law prohibits that result.

Nothing in this document removes mandatory consumer remedies or transfers to the participant a risk that Portuguese law places on the service provider. Any unlawful term is severed only to the minimum extent required, and the remaining agreement continues where legally possible.

5. Supervision and emergency procedures

Follow the coach’s activity-specific briefing, communication signals, equipment checks and rescue procedures. Breath-hold and apnea exercises must take place under appropriate supervision; do not practise them alone. Tell the team immediately if you feel unwell or unsafe. For an emergency in Portugal, call 112 and follow the emergency services’ instructions.

6. Insurance and operational clearance

The provider must verify insurance appropriate to the actual activities, including personal-watercraft operations, and any required registrations, professional qualifications and local permissions before delivery. Relevant insurance information must be provided before booking. This document does not assert that a particular policy or registration is in place and cannot replace those requirements.

7. Participation acknowledgement

Before participation, the team must give you the opportunity to ask questions and retain the relevant activity information, safety briefing and cancellation terms. Any formal acknowledgement is collected separately, with the applicable document version. It does not waive mandatory consumer rights or permit an unlawful exclusion of liability.
